Why set up an EHS regulatory watch?

The main purpose of EHS regulatory monitoring is to identify all the regulatory texts and requirements affecting an industrial activity in terms of environmental, health and safety management, with a view to managing the company's compliance. Indeed, beyond knowing the list of regulatory requirements that apply to it, a company will above all be interested to know whether or not it complies with them and, if not, to be able to define an appropriate action plan.

Regulatory texts are very numerous in France, with over 3,000 applicable regulatory requirements (generally between 2,500 and 3,500 requirements; one text generally containing several regulatory requirements). A requirement is defined as a homogeneous part of a text or of one of its articles explaining a particular obligation‍

How can you establish an EHS regulatory monitoring system?

Step 1: Select your sources of information

It's a good idea to consult a number of external sources, including official ones and those of industry specialists. For example, the Legifrance website lists national laws, decrees, codes and orders. The JO (Journal Officiel de la République Française) website lets you consult and stay abreast of legislative and regulatory news in France. As for the BO (Bulletins Officiels des différents ministères), they contain all texts classified by field. You'll need to select the ministries working in the fields of health, safety, environment and energy (for example: BO of the Ministry of Ecology, Sustainable Development and Energy).

Step 2: Analyze and select potentially applicable texts

A first sorting can generally be made by observing the title of each text and checking the organization behind its publication.

Step 3: Deepen your analysis by summarizing each text

At this stage, ask yourself the following questions: What is the general regulatory scope of this text? In other words, what does this text impose on the site(s)? What are its main provisions ? What is the deadline for its application?

Step 4: Identify the requirements applicable to each site

This stage consists of selecting the requirements actually applicable to the site(s) from each of the texts that concern the site(s).

Step 5: Moving towards compliance

This is a requirement-by-requirement analysis(regulatory audit) of the compliance of the site(s). The aim is to determine the compliance status of the site(s) in order to identify the actions required to improve compliance.
