Supplier impact management and duty of vigilance

Who is subject to the duty of vigilance?

As corporate social responsibility expands, companies are increasingly required to consider the social, environmental, and governance risks associated with their operations, as well as those of their subcontractors and suppliers. In this context, supplier performance can be managed using specific indicators.

The duty of vigilance is a French, and soon to be European, obligation for commissioning companies to identify and prevent social, environmental, and governance risks related to their operations, the activities of their subsidiaries, and their business partners (subcontractors and suppliers). In France, the law of February 21, 2017, governs this duty of vigilance, aiming to ensure that large companies, particularly multinationals, consider human rights and environmental protection.

It applies to French companies that employ at least 5,000 employees in France, and those with over 10,000 employees in mainland France whose headquarters are located elsewhere in the world. These companies must establish and publish a vigilance plan to prevent environmental, human rights, and corruption risks in their own activities, as well as those of their subsidiaries, subcontractors, and suppliers, both in France and abroad.  

The duty of vigilance is enshrined in major international reference texts for multinational corporations.
