Conditions for water reuse in the food industry

Decree no. 2024-33 of January 25, 2024 creates a new section in the French Public Health Code,
, setting out the conditions under which wastewater may be reused for the
preparation, processing and conservation of all foodstuffs and goods
intended for human consumption, including the cleaning of premises,
installations and equipment. It defines the quality, monitoring, storage and
distribution requirements for these waters, as well as the categories of water excluded from this
scheme. In particular, this does not apply to water unsuitable for human consumption
and intended for domestic or industrial use (within
installations classéesICPE or, for certain categories, IOTA), nor to rainwater, the use of which is already governed by the French Environment Code
.

New rules for monitoring the quality of water intended for human consumption

The monitoring procedures for surface fresh waters used or intended to be used for
the production of water intended for human consumption, and for waters used in the manufacture
of ice cream, have been reformed. In the case of the former, all
samples taken must be below the quality limits set by decree.
In the case of the latter, the control point for compliance with quality limits and references
must now be located directly at the point of production.

Addition of substances and changes to the classification of certain substances in table 3 of annex VI of the CLP regulation

Regulation (EC) No 1272/2008 of the European Parliament and of the Council of December 16, 2008
on classification, labeling and packaging of substances and mixtures
AMENDED BY Commission Delegated Regulation (EU) 2024/197 of October 19, 2023
amending Regulation (EC) No 1272/2008 as regards the harmonized classification and labeling
of certain substances [OJEU January 5, 2024].

As part of the 21st Adaptation to Technical Progress (ATP), 28 new substances
have been added to the list of hazardous substances requiring labeling. The classification and
names of other substances have also been updated. This new ATP may have
implications for ICPE classification, chemical risk assessment conclusions,
relabeling in the event of repackaging, and for obtaining updated safety data sheets
from suppliers.
