New F-Gas regulations

Regulation (EU) 2024/573 of the European Parliament and of the Council of 7 February 2024 on fluorinated greenhouse gases [OJEU of 20 February 2024].

As part of the objective of reducing the European Union's greenhouse gas (GHG) emissions by 55% by 2030 - compared with 1990 levels - and achieving carbon neutrality by 2050, this regulation specifies the provisions relating to the placing on the market, use, reduction and control of installations containing certain fluorinated GHGs, in particular by :

1.further regulating the use of unsaturated hydro(chloro)fluorocarbons (HFOs) ;

2.accelerating the reduction of hydrofluorocarbon (HFC) consumption ;

3.setting new marketing bans ;

4.reinforcing HFC trading provisions.

Compared with the previous F-Gas regulation, this one brings new definitions, broadens the scope of gases concerned and periodic leak checks, specifies the leak detection system, and specifies certification and training requirements for activities involving fluorinated GHGs...

This text repeals Regulation (EU) No. 517/2014 of April 16, 2014 on fluorinated GHGs.

New CESO regulations

Regulation (EU) 2024/590 of the European Parliament and of the Council of 7 February 2024 on substances that deplete the ozone layer [OJEU 20 February 2024].

As part of the European Green Pact, this regulation (EU) 2024/590 of February 7, 2024 on substances that deplete the ozone layer aims to strengthen the implementation of existing provisions applicable to these substances.

It lays down rules on the production, import, export, placing on the market, storage, subsequent supply, use, recovery, recycling, reclamation and destruction of CFCs, HCFCs, halons and other ozone-depleting gases.

In order to combat accidents in the waste sector, the decree of January 8, 2024 reinforces the fire-fighting provisions applicable to the 2710-1 declaration heading. It also reinforces the provisions applicable to lithium battery waste in relation to the 2710-2 declaration heading.

Generally speaking, the term "battery" has been replaced by "pile" in the first ministerial decree on general requirements, which means that batteries do not necessarily have to be stored in dedicated premises sheltered from the weather; that staff do not have to be authorized to receive battery waste; that battery waste areas are not inaccessible to the public; and that batteries can be decanted.

In addition, for new and existing facilities, whenever waste electrical and electronic equipment (WEEE) is likely to contain lithium batteries, they must be separated from other WEEE as soon as they are received, and stored in conditions that ensure they are not damaged by handling operations.

Classification of woods and forests exposed to fire risk

Order of February 6, 2024 classifying woods and forests exposed to fire risk under articles L. 132-1 and L. 133-1 of the French Forest Code [JORF du 9 février 2024].

In application of the law relating to forests, which aims to reinforce the prevention and fight against the intensification and extension of the risk of fire, and the legal obligations to clear undergrowth, this decree defines the woods and forests exposed to the risk of fire. It also lists excluded woods and forests located in departments particularly exposed to fire risk.

These include the following territories: Alpes-de-Haute-Provence, Hautes-Alpes, Alpes-Maritimes, Ardèche, Ariège, Aude, Aveyron, Bouches-du-Rhône, Corse-du-Sud, Haute-Corse, Dordogne, Hérault, Landes, Lot, Lot-et-Garonne, Lozère, Pyrénées-Atlantiques, Hautes-Pyrénées, Drôme, Gard, Gironde...
