On March 5, 2014, the decree* creating the 4000 headings within the ICPE nomenclature was published. It will come into force on June 1, 2015.
The creation of the 4000 headings serves a dual purpose:
- Harmonize the ICPE nomenclature with the new classification of hazardous substances and mixtures under CLP Regulation No. 1272/2008 of December 16, 2008
- Transpose the new classification criteria for Seveso sites introduced by the Seveso 3 Directive 2012/18 of July 4, 2012, in application of the CLP classification.
Overall, the decree makes the following changes:
- Creation of 2 1000 items,
- Creation of 81 4000 items,
- Modification of 6 headings (1434, 1435, 1450, 1630, 2795 and 2970,
- Deletion of 64 1000 headings
It also inserts 2 new articles into the Environment Code (articles R. 511-11 and R. 511-12) to define the cumulative rules for calculating and establishing " SEVESO low threshold and high threshold classifications".
The following architecture is envisaged for the new 4000 headings:
- Heading 4000: General definition of hazardous substances and mixtures
- Heading 4001: Cumulative rule for Seveso Seuil bas classification of an establishment
- Headings in 4100: Toxic
- Headings in 4200: Explosives
- Headings in 4300: Flammables (gases, aerosols, liquids)
- Headings in 4400: Self-reactive substances - Organic peroxides - Oxidizers (solids, liquids)
- Headings in 4500: Dangerous for the environment
- Headings in 4600: Other Seveso hazards (e.g. substances emitting flammable gases when in contact with water)
- Headings 4700 and 4800: Named substances directly or indirectly linked to the Seveso directive
- Headings in 4900: Other non-Seveso headings
