Transposition of the revisions to the Emissions Trading Scheme (ETS) adopted in May 2023 by the European Union

Code de l'environnement Articles R. 229-5 to D. 229-38-10: Greenhouse gas emission allowances AMENDED BY decree no. 2024-546 of June 14, 2024 relating to the European Union greenhouse gas emission allowance trading scheme and its corrigendum [JORF of June 16, 2024].

Decree no. 2024-546 transposes the revisions to the EU ETS adopted by the European Union in May 2023.

First of all, changes have been made to the scope of the text, and in particular to the list of activities subject to the ETS. These include, for example, oil refining, cast iron production, alumina production and black carbon production.

The decree then clarifies the conditionality of the free allocation of quotas to :

  • implementation of energy audit and Energy Management System (EMS) recommendations;
  • Climate Neutrality Plans (PNC).

Finally, in addition to various other changes, the quota allocation timetable has been revised, and a deadline has been set for the correction of non-conformities.

Radon risk prevention approach

Order of May 15, 2024 concerning the radon risk prevention approach and the implementation of a radon zone and associated checks as part of the reinforced worker protection system [JORF of June 6, 2024].

This decree sets out the terms and conditions for implementing the "radon zone" specifically for radon from the ground*, as well as the technical conditions for making this zone intermittent.

It also sets out certain provisions for risk prevention and reduction, as well as the implementation of a reinforced radon risk prevention system.

It applies to workplaces located inside buildings, as well as to specific workplaces defined by decree.

*Soil-derived radon is defined as radon generated directly by soil rocks or secondarily by water circulating in these rocks or materials extracted from them.

Electrical risk prevention for non-electrical work carried out in the vicinity of overhead or underground electrical installations

This text defines the specific requirements for non-electrical work carried out in the vicinity of overhead or underground electrical structures or installations that an employer, project owner or project manager must implement to ensure the safety of workers carrying out such work against electrical hazards.

The following are excluded from the scope of this text:

  • construction, operation and maintenance of electrical power distribution facilities and their ancillaries;
  • work carried out in the environment of rail or guided transport systems and cog railroads;
  • work carried out in the vicinity of electrical installations.

Conditions, procedures, formalization and traceability of asbestos detection prior to certain civil engineering, transport infrastructure or miscellaneous network operations

Order of June 4, 2024 concerning asbestos detection prior to certain operations carried out in buildings other than buildings such as civil engineering structures, transport infrastructures or various networks [JORF of June 30, 2024].

This decree defines the conditions under which asbestos surveys are carried out prior to certain operations carried out in buildings other than buildings, such as civil engineering structures, transport infrastructures or miscellaneous networks.

It provides information on :

  • asbestos-containing work and products;
  • the asbestos surveyor ;
  • to the location report ;
  • individual and collective protective equipment.
