As a reminder, DC classified installations (Declaration with Periodic Inspection) under one of the headings listed below must undergo a periodic inspection by an accredited body, unless they are operated within a facility that also includes at least one ICPE subject to Authorization or Registration.
Such an inspection must be carried out every 5 years (every 10 years if the facility is EMAS or ISO 14001 certified).
In the event of "major" non-conformities in DC classified installations detected during the inspection, these must be resolved within 1 year. Failure to do so requires the inspection body to notify the prefect.

Changes regarding major non-conformity in DC classified installations
Two decrees dated July 1, 2013, amend the 41 decrees on general requirements applicable to ICPEs subject to declaration under the following headings:
- 1111, 1136, 1138, 1172, 1173, 1435, 1510, 2220, 2351, 2415, 2510, 2562, 2564, 2565, 2570, 2710-1, 2710-2, 2711, 2716, 2718, 2781-1, 2791, 2795 and 2950;
- 8, 1310, 1311, 1330, 1331, 1412, 1413, 1414, 1432, 1433, 1434, 2160, 2550, 2551, 2552, 2930 and 2940.
These general requirement decrees have been amended to define the inspection points that constitute major non-conformities.
The procedure for major non-conformity in DC classified installations
In practical terms, every affected operator must:
- Within 3 months of receiving the report => Submit a schedule of planned measures to resolve major non-conformities to the inspection body
- Within 12 months of receiving the report => Request a follow-up inspection from the same body to verify that major non-conformities have been resolved (Inspection to be carried out within 2 months of the request + 1 month for the report to be finalized)
The inspection body is required to notify the prefect of major non-conformities in the following cases:
- if it has not received the operator's compliance schedule within the 3-month deadline;
- if it has not received a written request for a follow-up inspection within 1 year;
- if the follow-up inspection reveals that major non-conformities persist.

Simplifying the reading of general requirement orders (APG)
Furthermore, these July 1st orders introduce a simplification: the appendices containing general requirements and those containing requirements subject to periodic inspections have been merged. Consequently, in these general requirement orders, a single appendix defines the general requirements and specifies those subject to periodic inspection (the latter include, where applicable, points relating to major non-conformities).
Conditions of application
These amendments will come into force on January 1, 2014.
Note: for certain categories mentioned above, it will be necessary to wait for the publication of the appendices to the two July 1, 2013 orders in the Ministry of Ecology's Official Bulletin to observe these developments and review the exact changes introduced.
