At the end of last year, the ICPE nomenclature (classified installations) was amended by Decree No. 2014-1501 of December 12, 2014. On this occasion, 5 categories were modified:
- 1185 (fluorinated greenhouse gases)
- 1310 and 4210 (explosive products)
- 1432 (flammable liquids)
- 2760 (waste storage)
5 ICPE nomenclature categories amended
Category 1185
This category concerns the manufacture, use, and storage of ozone-depleting substances (ODS) and fluorinated greenhouse gases (F-gases). In practical terms, it targets installations such as refrigeration units, air conditioning, heat pumps, etc., containing refrigerants.
The amendment replaces Regulation (EC) No 842/2006 of May 17, 2006, in the category title with the F-Gas Regulation (EU) No 517/2014 of April 16, 2014, which repealed it and is now the reference text on the subject. It is therefore a regulatory adjustment.
Categories 1310-3.b and 4210-2.b
These categories concern mobile explosives manufacturing units (e.g., machinery or equipment used in quarries or public works sites).
The amendment removes the requirement for these mobile units to be periodically inspected by an approved body (meaning the classification changes from 'DC' to 'D').
Section 1432-1
This section concerns the storage of flammable liquids in manufactured tanks.
The amendment adds an AS (Authorization with Servitude) threshold when the quantity of flammable liquids covered by section 1430 that may be present is equal to or greater than 25,000 tonnes for heavy fuel oils, in accordance with the Seveso 3 Directive of July 4, 2012, and to ensure consistency with the new section 4734, which already mentions this threshold but is only applicable from June 2015. The amendment to section 1432 is applicable from December 13, 2014, until June 1, 2015.
Section 2760
This section concerns waste storage facilities other than those mentioned in section 2720.
Inert waste storage activity is now included under the ICPE regime (creation of point 3 in this section 2760). The facilities concerned are directly subject to registration without a submission threshold. They are no longer subject to the specific authorization regime specified in Article L. 541-30-1 of the Environmental Code.
Furthermore, temporary storage facilities for metallic mercury waste, which become classified installations as of June 2015, will be classified as requiring authorization without a threshold from that date, rather than from the 200-tonne threshold of quantity that may be present in the facility as initially provided for by Decree No. 2014-285 of March 3, 2014.
Conclusion of the ICPE nomenclature amendments
These amendments of December 12, 2014, came into force on December 13, 2014, with the exception of the provisions relating to inert waste storage and fluorinated greenhouse gases, which have applied since January 1, 2015.
