As a reminder, article R. 126-10 of the French Construction and Housing Code (CCH) requires project owners carrying out demolition work on certain buildings and significant renovation work to carry out a preliminary diagnosis concerning the management of products, equipment, materials and waste resulting from this work.
Last June, decree no. 2021-821 of June 25, 2021 extended the scope of waste diagnosis as follows:
- By applying the previous thresholds, in cumulative terms, to all operations carried out on buildings (and no longer individually for each building),
- By newly integrating significant building renovations (and not just demolitions).

It should also be noted that, as of January 1, 2022, the project owner must submit all diagnostics and inspection forms to the Centre Scientifique et Technique du Bâtiment (CSTB), in accordance with the following procedures:
- For waste diagnosis, prior to acceptance of quotations or award of contracts for demolition or major renovation work;
- For the recolement form, within ninety days of completion of demolition or significant renovation work.
The changes introduced by the two decrees apply to demolitions and major renovations of buildings for which the date of submission of the application for a demolition permit, the date of submission of the planning permission and the date of submission of the works permit (or, failing that, the date of acceptance of the estimates or award of the contracts relating to the demolition or major renovation work), is after January 1, 2022.
(*) A significant renovation of a building is considered to be an operation consisting in the destruction or replacement of at least two of the finishing elements mentioned below, provided that the work concerned leads to the destruction or replacement of a majority part of each of these elements:
- Floors that do not determine the strength or rigidity of the structure ;
- External partitions that do not determine the strength or rigidity of the structure;
- Exterior frames ;
- Interior partitions ;
- Plumbing and sanitary installations;
- Electrical installations ;
- Heating system.
