Amendment to the section 2910 : Combustion installations with a rated thermal input between 1 MW and 2 MW are now subject to ICPEregulations. They must notify the prefect before December 20, 2019, to benefit from acquired rights for installations commissioned before the amendment of the ICPE nomenclature.

Directive (EU) 2015/2193 of November 25, 2015, on the limitation of emissions of certain pollutants into the air from medium combustion plants, was transposed into French law through the publication of several texts, which led to an amendment of the ICPE section. Due to the lowering of the declaration threshold for sub-section 2910-A, combustion installations with a rated thermal input between 1 MW and 2 MW are now subject to ICPE regulations.
The ministerial order of August 3, 2018, stipulates that installations regularly commissioned, which become subject to ICPE regulations, may continue to operate without authorization, registration, or declaration, provided that the operator notifies the prefect within one year following the entry into force of the decree, published on December 20, 2018.
Following the amendment of section 2910, you therefore have until December 20 to submit your prior rights application. Two options are available to you:
- Online application, directly on the Service publicwebsite.
- By completing the Cerfa form n° 15274*02 and sending it to your prefecture.
