Heading 2910: don't forget to apply for anteriority before December 20, 2019!

Combustion plants between 1 and 2 MW are subject to ICPE regulations. Their operators must register with the prefect before December 20, 2019.

Modification of heading 2910: Combustion plants with a rated thermal output of between 1 MW and 2 MW are now subject to ICPE regulations. They must make themselves known to the prefect before December 20, 2019, in order to benefit from acquired rights for facilities commissioned before the change to the ICPE nomenclature.

Don't forget to apply for grandfathering rights before December 20!

Directive (EU) 2015/2193 of November 25, 2015, on the limitation of emissions of certain pollutants into the atmosphere from medium-sized combustion plants, has been transposed into French law by the publication of several texts, which have led to a modification of the ICPE heading. As a result of the lowering of the declaration threshold for sub-heading 2910-A, combustion plants with a rated thermal output of between 1 MW and 2 MW are now subject to ICPE regulations.

The ministerial decree of August 3, 2018 stipulates that regularly commissioned facilities that become subject to ICPE regulations may continue to operate without authorization, registration or declaration, provided the operator makes itself known to the prefect within a year of the decree's entry into force, published on December 20, 2018.
