Each year, an instruction from the French Ministry of Ecological Transition defines the national actions of the inspection of facilities classified for environmental protection (ICPE).
For the year 2022, it is therefore the instruction of December 22, 2021, published on January 4, 2022, which has defined the priorities for ICPE inspections.
Firstly, "sustainable" actions:
- Policing of classified facilities (inspection visits, review of permit applications, examination of studies submitted by the operator, combating illegal operations, including waste management, etc.);
- Other policing missions, inside and outside classified facilities (enforcement of mining and post-mining regulations; control of hazardous equipment and products);
- Integration of technological and health risks (preparation of the latest PPRT plans, management of polluted sites and soils, information for operators and stakeholders on regulations and the state of the environment, etc.).
Secondly, priority thematic actions:
- Traceability of excavated soil: In the 2nd half of the year, the Classified Installations Inspectorate will check compliance with obligations relating to the traceability of excavated soil, by verifying the correct declaration of information relating to excavated soil in the national register of excavated soil.
In addition to these priorities for the inspection of ICPEs, this instruction also sets out thematic guidelines for inspection visits:
- On the one hand, systematic actions :
- Inspection of classified facilities located less than 100 meters from Seveso sites to identify any sensitive facilities located near site boundaries, presenting risks of domino effects;
- Control action on the transmission and updating of waste management plans (PGD) for quarries subject to headings 2561-1 and 2720.
- Inspection visit focused on the SMP and biodiversity when new provisions have been introduced.
- On SEVESO sites, targeted inspections of subcontractors are carried out in three areas: risk training/awareness of outside operators or companies, control of operating procedures and control of emergency procedures;
- Actions to control the landfilling of eligible waste: Verification of compliance with the ban on the disposal of recoverable waste in non-hazardous waste landfills, and the transmission of documents justifying compliance with source separation obligations by the waste producer when disposing of non-hazardous waste by incineration or landfill.
