Priority actions for the inspection of Classified Facilities for Environmental Protection

The instruction of December 22, 2021, sets the 2022 priorities for ICPE inspections: ongoing missions, thematic actions, and targeted checks.

Each year, an instruction from the Ministry for the Ecological Transition defines the national actions for the inspection of installations classified for environmental protection (ICPE).

For 2022, the instruction of December 22, 2021, published on January 4, 2022, defined the priorities for ICPE inspections.

First, "ongoing" actions:

  • Police duties for classified installations (inspection visits, processing of authorization requests, review of studies submitted by operators, combating illegal operations, particularly in waste management, etc.);
  • Other police duties, both within and outside classified installations (enforcement of mining and post-mining regulations; inspection of high-risk equipment and products);
  • Integration of technological and health risks (preparation of final technological risk prevention plans (PPRT), management of polluted sites and soils, informing operators and stakeholders about regulations and the state of the environment, etc.).

Second, priority thematic actions:

  • Traceability of excavated soil : In the second half of the year, the classified installations inspection service will verify compliance with obligations regarding the traceability of excavated soil by checking that information is correctly declared in the national excavated soil registry.

Alongside these ICPE inspection priorities, this instruction also sets thematic guidelines for inspection visits:

  • Firstly, systematic actions:
  1. Inspection of classified facilities located within 100 meters of Seveso sites to identify any sensitive facilities located near site boundaries that present risks of domino effects;
  2. Control action regarding the transmission and updating of waste management plans (WMP) for quarries subject to headings 2561-1 and 2720.
  3. Inspection visit focused on the WMP and biodiversity when new provisions have been introduced.
  4. On SEVESO sites, inspections focused on subcontracting based on three areas: training/awareness of risks for external operators or companies, control of operating procedures, and control of emergency procedures;
  5. Control actions for the landfill entry of admissible waste: Verification of compliance with the ban on disposing of recyclable waste in non-hazardous waste storage facilities and the transmission of documents justifying compliance with source-sorting obligations by the waste producer to eliminate non-hazardous waste by incineration or landfilling.
