Modification of headings 2251 and 2630

Code de l'environnement Articles R. 511-9 to R. 511-12: Nomenclature des installations classées MODIFIE PAR le décret n° 2023-943 du 11 octobre 2023 modifiant la nomenclature des installations classées pour la protection de l'environnement [JORF du 13 octobre 2023].

The decree of October 11, 2023 firstly abolishes the authorization regime for ICPE heading 2251 (preparation and packaging of wines, excluding installations classified under heading 3642). The thresholds for declaration and registration remain unchanged. In the case of heading 2630 (manufacture of detergents and soaps, excluding activities classified under heading 3410), the authorization system has been replaced by a registration system.

General requirements applicable to installations subject to registration under heading 2630 (manufacture of detergents and soaps) of the nomenclature of classified installations for environmental protection.

This decree sets out the general requirements applicable to ICPEs registered under heading 2630. This concerns the manufacture of detergents and soaps when production capacity exceeds 50 t/d.

Changes in public participation procedures

The French Green Industry Act provides for the modernization of public consultation. From now on, the environmental authorization process will be divided into two phases (instead of three) to shorten the timeframe:

  1. The examination and consultation phases take place simultaneously;
  2. A decision phase.

The examination and consultation phase now lasts three months (previously five, except in special cases).

Incorporating best available techniques, improving fire-fighting and facilitating the operation of landfill sites operated in "bioreactor" mode to optimize their biogas production.

Arrêté du 15 février 2016 relatif aux installations de stockage de déchets non dangereux MODIFIE PAR l'arrêté du 7 août 2023 [JORF du 27 octobre 2023]

Following the publication of the Best Available Techniques (BATs) for waste treatment facilities on August 17, 2018, the Order of August 7, 2023 aims to identify and prescribe the BATs applicable to non-hazardous waste storage facilities subject to authorization under heading 2760 of the ICPE nomenclature, in order to have a relevant benchmark as part of the review procedure that will end on August 17, 2025.

New occupational disease table for cancers of the larynx and ovary caused by inhalation of asbestos dust

Table 30 ter has been added to the occupational disease tables, covering cancers of the larynx and ovary caused by inhalation of asbestos dust. The period of coverage is 35 years, subject to a minimum exposure period of 5 years. The restrictive list of jobs likely to cause these diseases includes :

  • Work directly associated with the production of asbestos-containing materials;
  • Work requiring the use of bulk asbestos ;
  • Insulation work using asbestos-containing materials ;
  • Asbestos removal work ;
  • Installation and removal of asbestos-based insulating materials;
  • Shipbuilding and ship repair....
