ENVIRONMENT
New regulation on transboundary shipments of waste
Regulation (EU) 2024/1157 of the European Parliament and of the Council of 11 April 2024 on shipments of waste [OJEU of 30 April 2024].
This regulation sets out the rules for the shipment and disposal of waste within the European Union and into and out of the European Union. It applies to the following waste shipments:
- Between member states within the European Union, with or without transit through third countries;
- Imported into the EU from third countries ;
- Exported from the EU to third countries ;
- Transiting through the Union to and from third countries.
It then sets out the various obligations and prohibitions applicable in these different situations, as well as the associated application methods and procedures.
This regulation repeals and replaces the former regulation (EC) no. 1013/2006 of June 14, 2006 on shipments of waste.
ENERGY
Application of specific provisions for agrivoltaic installations
Code de l'énergie Articles R. 314-108 à R. 314-123 : Dispositions spécifiques à la production d'électricité à partir d'installations agrivoltaïques CREE PAR le décret n° 2024-318 du 8 avril 2024 relatif au développement de l'agrivoltaïsme et aux conditions d'implantation des installations photovoltaïques sur des terrains agricoles, naturels ou forestiers [JORF du 9 avril 2024].
As a reminder, an agrivoltaic installation is an electricity production facility that uses the sun's radiative energy and whose modules are located on an agricultural plot where they make a lasting contribution to the installation, maintenance or development of agricultural production. It must provide a direct service to the plot, guaranteeing significant agricultural production and a sustainable income for an active farmer, and must not prevent agricultural production from being the main activity on the plot.
These articles specify the concepts associated with these installations, the conditions for setting up agrivoltaic installation projects, and the procedures for monitoring these installations.
SAFETY
Extension of the validity of the "certiphyto" individual certificate for the use of phytopharmaceutical products in the context of professional activity
Decree no. 2024-326 of April 9, 2024 extending by one year the period of validity of the individual certificate provided for in II of article L. 254-3 of the rural and maritime fishing code [JORF of April 10, 2024].
The period of validity of "certiphyto" for individuals who use plant protection products in the course of their professional activity as employees, on their own account, or under a mutual assistance contract free of charge, is extended by one year when it expires between April 10, 2024 and May 1, 2025.
Procedures for workers in hyperbaric environments in the context of mention D
Order of April 22, 2024 concerning hyperbaric work performed without immersion (mention D) [JORF of April 26, 2024].
This decree defines the methods and procedures applicable to workers carrying out interventions without immersion in a hyperbaric environment, i.e. exposing workers to relative pressures in excess of 100 hectopascals, mention D.
Pursuant to the Labour Code, this order specifies :
- Provisions common to the different methods of intervention in hyperbaric environments ;
- The specifics of non-immersion work in hyperbaric environments.
