Remote declaration of ICPEs subject to declaration: until December 31, 2020 to submit paper declarations

Since January 1ᵉʳ 2016, ICPE procedures subject to declaration have been dematerialized. Operators must teledeclare via the Service Public website or via specific forms.

Since January1, 2016, procedures applicable to classified facilities (ICPE) subject to declaration have been dematerialized, known as ICPE remote declaration. This change has been incorporated into regulations via Decree no. 2015-1614 of December 9, 2015, which amended Articles R. 512-47 to R. 512-66-2 of the Environmental Code and the Order of December 15, 2015 on the dematerialization of the declaration of facilities classified for environmental protection.

The procedures concerned by the ICPE remote declaration :

  • transmission of the declaration by the operator
  • proof of filing
  • access to general regulations applicable to the plant
  • request to modify the applicable general regulations
  • the exercise of prior rights (otherwise known as "grandfathering")
  • declaration of modifications made by the operator to the installation
  • plant shutdown notification

Declaration procedures

So, since January1, 2016, ICPE declarations have had to be made online via the Service Public website. Paper declarations will remain possible until December 31, 2020, and 5 CERFA forms have been approved for this purpose:

  • for the declaration: CERFA n° 15271 ;
  • for the modification declaration: CERFA n° 15272 ;
  • for notification of final shutdown: CERFA n° 15275 ;
  • for the declaration of change of operator : CERFA n° 15273 ;
  • for prior rights: CERFA n° 15274.

These forms are available on the same website: Use of these forms is either compulsory or optional, depending on the status of any other facilities operating on the site. There are three possible cases (table taken from the Cerfa forms explanatory leaflet):

The online ICPE declaration service is now available on the Service Public website.

The general process

Once the declaration has been submitted electronically, a proof of filing is issued, and the general requirements are made available on the Internet.

Before requesting proof of filing, the operator must acknowledge that he has read and understood the general requirements. The proof of filing is made available on the website of the prefecture where the facility is located for at least 3 years.

On the occasion of this change in procedures, it is recalled (via the order of December 15, 2015) that the general prescriptions apply to installations subject to declaration present in a facility that includes at least one installation subject to authorization whenever these installations are not governed by the prefectoral authorization order.

Until December 31, 2020, the declaration can still be submitted on paper, in triplicate. Proof of submission is then issued on paper, and publicized on the prefecture's website. It is accompanied by a copy of the general regulations applicable to the facility.

Similarly, until December 31, 2020, requests for modifications to general requirements and information to the Prefect concerning modifications to the facility may be submitted on paper.

This way of filing returns makes the administration's work easier, simplifies life for companies, and ensures greater harmonization of application files.
