A decree reinforces the traceability of workers' exposure to CMR chemical agents, and updates the binding TLVs for certain substances.

Strengthening the traceability of workers exposed to carcinogenic, mutagenic or reprotoxic chemicals

Decree no. 2024-307 introduces new provisions relating to the traceability of workers' exposure to carcinogenic, mutagenic or toxic to reproduction (CMR) chemical agents.

By July 5, 2024, employers must draw up an updated list of workers likely to be exposed to CMR chemical agents. This list must indicate, for each worker, the substances to which he or she is likely to be exposed and, where known, information on the nature, duration and degree of exposure.

The procedures for communicating this list are also specified. In detail, the list must be communicated, along with any updates, to occupational health and prevention services (or, where applicable, to occupational health services in agriculture). The information they contain is then added to the occupational health medical file of the workers concerned.

In addition, if a temporary worker is employed, the user company must send the temporary employment agency the information on the list, and any updates, concerning this worker.

In addition, the employer must make available to employees the information on the list which concerns them personally. He must also make the information on this list, presented anonymously, available to employees and to members of the staff delegation of the social and economic committee.

Finally, if a worker suffers either an occupational disease or an abnormality likely to result from exposure to a reprotoxic agent, all workers with comparable exposure in the same workplace must now undergo a medical examination, possibly accompanied by further tests.

Updating of binding TLVs

Combined with the reinforcement of worker traceability, the decree transposes into French law the novelties of directive 2022/431 of March 9, 2022 by setting new occupational exposure limit values (VLEP) (link to the following page of the EHS blog: VLEP: reminder and regulatory changes as of July 1 ) for the substances listed in the table below.
