Closure of classified facilities: Company certification and attestations

Since June 2022, ICPE operators have had to rely on a certified company to attest to the proper implementation of their cessation of activity and comply with the new regulatory requirements.

As a reminder, procedures for the cessation of ICPE activities were revised by Decree no. 2021-1096 of August 19, 2021, issued in application of Article 57 of Law no. 2020-1525 of December 7, 2020 ("ASAP" law).

In particular, from June1, 2022, operators of ICPEs (authorization, registration and declaration) will be required to certify that their activities have been properly terminated by a company certified in the field of polluted sites and soils.

Within this framework, an order dated February 9, published in the Journal Officiel of February 25, defines the certification procedures for these companies and the attestations required, in particular for the cessation of ICPE activity.

This decree provides a framework for company certifications by specifying :

  • Certification standards ;
  • The certification process consists of initial certification and renewal phases (admissibility study, conformity assessment by audit, decision and certification);
  • The certification process for companies with multiple sites ;
  • Certification transfer ;
  • Certification equivalents.
