Cessation of classified installations: Company certification and certificates

Since June 2022, operators of ICPE facilities must rely on a certified company to verify the proper implementation of their cessation of activity and to comply with new regulatory requirements.

As a reminder, the procedures for cessation of activity for ICPE facilities were revised by Decree No. 2021-1096 of August 19, 2021, issued pursuant to Article 57 of Law No. 2020-1525 of December 7, 2020 (the "ASAP" Law).

It is specifically provided that, as of June 1st , 2022, operators of ICPE facilities (subject to authorization, registration, and declaration) must certify the proper implementation of their cessation of activity by engaging a certified company in the field of polluted sites and soils.

In this context, an order dated February 9, published in the Official Journal on February 25, defines the certification procedures for these companies and the required attestations, particularly for the cessation of activity of ICPE facilities.

This decree regulates company certifications by specifying:

  • Certification standards;
  • The certification process, consisting of initial certification and renewal phases (eligibility review, compliance assessment via audit, decision, and certification);
  • The certification process for companies with multiple locations;
  • Certification transfer;
  • Certification equivalencies.
