Regulatory changes applicable to combustion plants

In 2018, Directive (EU) 2015/2193 of November 25, 2015 on the limitation of emissions of certain pollutants into the air from medium-sized combustion plants (MCPs) was transposed into French law. In our last newsletter, we provided an update on the legislative developments. Classified installations have been impacted by several changes to the nomenclature, the most significant of which has been the evolution of heading 2910.

Modification of seismic regulations applicable to Seveso facilities

The seismic rules applicable to Seveso classified facilities under the decree of October 4, 2010, considered to be the most dangerous in the event of an accident for the environment and populations, have been modified to reinforce the monitoring of equipment at risk in the event of an earthquake, and to simplify the constitution of certain financial guarantees.

Two guides to help operators implement the RSDE decree

The RSDE decree, aimed at reducing discharges of hazardous substances into water, one of the major topics of our 2017 EHS retrospective, has been supplemented by two guides published by the Ministry of Ecological Transition and Solidarity, to support operators in its implementation.

Decree on the inspection of air conditioning systems and reversible heat pumps

The decree on the inspection of air conditioning systems and reversible heat pumps with a rated cooling capacity of over 12 kilowatts, came into force on July 1, 2018. It modifies the frequency and terms of periodic inspections of these systems. An air-conditioning booklet is created to facilitate efficiency and sizing inspections.

5 flux" decree: a model waste recovery certificate


The model for the "5-stream" waste recovery certificate (paper/cardboard, metal, plastic, glass and wood) that waste producers or holders are obliged to obtain from recovery providers or intermediaries by March 31 each year, has been published in an order, published on July 18, 2018, and applicable from January 1, 2019.

Ionizing radiation: transposition of the Euratom directive of December 5, 2013


In June 2018, two decrees were published, notably to transpose the Euratom Directive of December 5, 2013. The Public Health Code and the Labor Code were amended to update radiation protection classifications and simplify the process for monitoring workers' exposure to ionizing radiation. Further implementing decrees are expected.

EHS regulations: the outlook for 2019

What major EHS regulatory developments are expected in 2019? At least three: the obligation to identify asbestos prior to construction work, the expected BAT conclusions for IED installations, and energy renovation in commercial buildings.
