Integration of a shading and rainwater management system for parking lots

As a reminder, Act no. 2021-1104 of August 22, 2021 (known as the "Climate and Resilience" Act) introduced two types of obligations into the Construction and Housing Code and the Town Planning Code concerning parking facilities of over 500 m² associated with certain types of construction:
- Shade at least half of the park's surface area
- At least half of the park's footprint must be equipped with rainwater management systems.
Decree no. 2023-1208 of December 8, 2023 creates a sub-section concerning the obligation to equip parking areas with rainwater management and shading systems (shading systems integrating a renewable energy production process or vegetated systems). It defines the notion of "major renovation" and provides a number of clarifications relating to parking areas, rainwater management systems and shading systems, in particular with regard to technical and cost constraints.
Reinforcement of accidental risk prevention provisions for ICPEs registered under headings 2710-2, 2711, 2712-1, 2713, 2714 and 2716

In order to combat accidents in the waste sector, the decree of December 22, 2023 reinforces the provisions applicable to fire-fighting. The main changes concern the drafting and updating of Fire Defense Plans (PDI), fire and rescue service warning systems, and the organization of fire defense drills. Other provisions concern the storage, sorting and management of certain types of waste.
Accidental risk prevention provisions for ICPEs authorized under headings 2710, 2712, 2718, 2790 and 2791

Also with a view to combating accidents in the waste sector, the decree of December 22, 2023 sets out the general fire-fighting requirements applicable to facilities falling under the following headings: 2710, 2712, 2718, 2790 and 2791. The main additions concern the preparation of Fire Defense Plans (PDI), fire and rescue service warning systems, and the organization of fire defense drills.
Prevention of accidental hazards in classified facilities subject to authorization for wastes with properties equivalent to hazardous substances or mixtures

The decree makes the provisions relating to the prevention of risks associated with the ageing of certain equipment newly applicable to waste with properties equivalent to hazardous substances or mixtures, and likely to be the cause of a major accident. It is specified that such waste is provisionally assigned to the classes, categories and hazard statements closest to or the closest to the designated hazardous substance or mixture. These provisions are designed to combat accidents in the waste sector, and in particular to prevent the risk of fire.
Use of treated wastewater for watering green spaces open to the public and/or for crop irrigation

Against a backdrop of recurring periods of drought, the Decree of December 14, 2023 applies the Environmental Code to the use and conditions for reusing treated wastewater. It defines the types of treated wastewater that fall within the scope of application, and then specifies the conditions for using treated wastewater for green spaces. The use referred to in this decree is that of green spaces open to the public or with restricted public access, such as freeway service areas, cemeteries, golf courses, racecourses, parks, public gardens, small green spaces under the responsibility of local authorities (planters, flowerbeds), traffic circles and other medians, squares, stadiums, etc.
The decree of December 18, 2023 defines the requirements for irrigating crops with treated wastewater.
ENERGY
Roof integration of renewable energy production processes or vegetation systems

As a reminder, Law no. 2021-1104 of August 22, 2021 (known as the "Climate and Resilience" law) introduced, in the Construction and Housing Code, an integration obligation in the event of the construction, heavy renovation or extension of certain buildings:
- a renewable energy production process;
- or a vegetation system based on a cultivation method that guarantees a high degree of thermal efficiency and insulation, and promotes the preservation and recovery of biodiversity;
- or any other device achieving the same result.
The purpose of this section of the Construction and Housing Code is to define heavy renovation, and to clarify exemptions for the integration of a renewable energy production process (e.g. solar photovoltaic or solar thermal) and green roofing systems.

Skills required for MOT authorization applicants

Under article R. 5139-1 of the French Public Health Code, any production, manufacture, transport, import, export, possession, offer, transfer, acquisition or use of micro-organisms and toxins (MOTs) on the list defined by decree, as well as products containing them, must be authorized by the Director General of the Agence nationale de sécurité du médicament et des produits de santé (ANSM).
This decree specifies the minimum qualifications AND professional experience required of all applicants for MOT authorization.
