INSTRUCTION OF DECEMBER 15, 2023 RELATING TO THE 2024 NATIONAL ACTIONS OF THE INSPECTION OF CLASSIFIED INSTALLATIONS
The inspection of classified facilities is a key issue in ecological planning. The latter is structured around 3 main areas:
- Mitigating climate change;
- climate change adaptation ;
- Preserving biodiversity and resources.
Each year, an instruction from the Ministry of Ecological Transition and Territorial Cohesion sets out the permanent missions and priorities for action of the inspection of facilities classified for environmental protection (ICPE) for the coming year.
The December 15, 2023 instruction defines the priorities and thematic orientations of ICPE inspection visits for 2024.
In terms of inspection priorities, the following are particularly noteworthy:
Firstly, the "perennial" actions are identical for 2023, and include the following points:
- Policing of classified facilities: inspection visits, processing of authorization and registration applications, examination of studies submitted by the operator (hazard studies, interpretation of environmental conditions and management plans, etc.), combating illegal facilities, particularly waste management facilities, etc.
- Other policing missions within and outside classified facilities: inspection of high-risk equipment and products (e.g. pressurized equipment), implementation of the anti-waste law, inspection of high-risk pipelines, etc.
- Integration of technological and health risks into planning and development: implementation of technological risk prevention plans, management of polluted sites and soils, information for operators and stakeholders on regulations and the state of the environment, etc.
Secondly, the thematic action priorities for 2024 differ from the previous year, with the exception of drought. The following points are addressed:
- Action to reduce the water consumption of industrial activities: support for 50 pilot sites (in conjunction with the water plan) by providing technical and regulatory support for the implementation of projects, monitoring of projects carried out in the region...
- Actions on per- and polyfluoroalkylated substances (PFAS) : checks on compliance with the requirements of the Order of June 20, 2023, analysis of the results of measures implemented, requirements and monitoring of operators' reduction or elimination initiatives...
- Control of atmospheric emissions (with a focus on volatile organic compounds): on-site inspection of effluent channelling or collection methods, inspection of channelled emission limit values and solvent management plan...
In addition to these priorities for the inspection of ICPEs, this instruction also sets out thematic guidelines for inspection visits:
- Systematic actions: control of accidental risks (inspection of facilities using ammonium nitrate, implementation of regulatory changes in 2021-2022 for flammable liquids and containment following the Rouen accident in 2019), fight against illegal trafficking in electrical and electronic waste.
- Actions to be chosen by region: These actions differ from those presented for 2023, with the exception of plastic packaging for vegetables, bans on disposable tableware, and the roll-out of Trackdéchets and the RNDTS register. These will be chosen from the lists below.
