01/01/2024: Change in gas detection threshold for combustion installations declared 2910
The sensitivity of gas detection systems in combustion plants declared under heading 2910 is to be improved: their detection threshold is to be reduced from 60% to 30% of the LEL (Lower Explosive Limit).
For installations whose declaration file was submitted before March 1, 2023, this detection must be modified by January 1, 2024.
01/01/2024: Assessing the risk of radon and other ionizing radiation: new methods for calculating effective doses
1) The dose coefficients used to calculate the effective dose of radon exposure have been updated. Until now, the threshold of an effective dose of 6 mSv/year (*) could be reached at around 950 Bq/m3.
Consequently, this threshold of 6 mSv/year can now be reached for radon activity concentrations in air of :
- 450 Bq/m3for sedentary activity
- between 100 and 150 Bq/m3for non-sedentary activities
(*) if this threshold is exceeded, the employer must implement certain measures (e.g. appointment of a radiation protection advisor, dosimetry, reinforced individual monitoring, etc.).
2) For other ionizing radiation (e.g. use of sealed sources, etc.), the rules for calculating effective doses have been modified.
01/01/2024: Greening of vehicle fleets
Companies managing a fleet of more than 100 light vehicles (*) must now acquire low-emission vehicles for at least 20% of their fleet renewals.
(*) When assessing the size of the fleet managed by a company, vehicles managed by its subsidiaries headquartered in France and vehicles managed by its establishments located in France are taken into account.
01/01/2024: Ban on disposal of certain wastes in non-hazardous waste storage facilities
The ban on the disposal of recoverable non-hazardous waste in non-inert non-hazardous waste storage facilities will apply from January 1, 2024 to the loading of skips or other containers with more than 30% biowaste by mass.
01/01/2024: New certibiocides
As a reminder, the use, sale and purchase of certain types of biocides for professional use are subject to obtaining an individual certibiocide certificate.
The following individual certificates are hereby created to replace the "professional user and distributor of certain types of biocidal products intended exclusively for professionals" certificate:
- Certibiocide disinfectants (type 2, 3 and 4 products for decision-makers, purchasers and distributors)
- Certibiocide pests (type 14, 18 and 20 products for professional users or distributors or purchasers & type 8, 15 and 21 products for professional users or distributors or purchasers)
- Certibiocide other products (product types 8, 15 and 21 for professional users, distributors and purchasers)
Professionals working as professional users, distributors or purchasers of product type 21, and professionals working as decision-makers, purchasers or distributors of product types 2, 3 and 4 have one year in which to obtain their certificate. Certificates issued up to December 31, 2023 are valid until the expiry date indicated on the certificate.
01/01/2024: Installation on roofs of new buildings, major renovations or extensions of a renewable energy production system or a green roof system.
Obligations to integrate a renewable energy production process or a vegetation system (or equivalent system) apply to the construction, extension and renovation of the following buildings:
- buildings or parts of buildings for commercial, industrial or craft use, warehouse buildings, hangar buildings not open to the public and used for commercial purposes, and covered parking lots accessible to the public, when they create more than 500 m² of floor space;
- office buildings or parts thereof, when they create more than 1,000 m² of floor space.
This applies to applications for planning permission for such projects submitted on or after January 1, 2024.
01/01/2024: Requirements for facilities subject to registration under at least one of the headings 4331 or 4734
As part of the implementation of the government's "post-accident" plan of September 26, 2019, existing facilities classified under headings 4331 or 4734 under the registration regime are now affected by the following provisions:
- Prohibition on the storage of category 1 flammable liquids (hazard statement H224) in meltable containers of the mobile type with a unit volume greater than 30 L;
- Completed fire defense plan ;
- Carry out a heat flow study to determine the distances corresponding to thermal effects in the event of an 8 kW/m² fire, at target height or, failing that, at man-height.
01/01/2024: Radiation protection (e.g.: use of sealed or unsealed sources) - reinforced individual monitoring (SIR) of exposed workers
As a reminder, workers classified in categories A and B or exposed to radon are subject to SIR monitoring.
1) As of January 1, 2024, occupational physicians and occupational health professionals will be required to undergo specific training on the risks associated with ionizing radiation and on the individual dosimetric monitoring system.
Note: As of January 1, 2026, occupational physicians and health professionals who have not received specific training will no longer be able to provide reinforced individual monitoring.
2) As of January 1, 2024, when the host company has an independent occupational health and safety service (SPST) with additional approval, the SIR of the external company's workers is provided, jointly with the external company's SPST, by the independent SPST in accordance with the procedures defined in the agreement between the companies.
Note: in the past, an agreement was signed when the external company's SPST was not approved to provide individual health monitoring for workers exposed to ionizing radiation.
The agreement must be appended to the prevention plan and forwarded to the DREETS and the Labour Inspectorate. In addition, the works councils of the host and contractor companies are informed of the implementation of the agreement.
