Details of the latest amendment to the ICPE nomenclature

A 2015 decree and corrigendum modified the ICPE nomenclature, deleting 3 headings and modifying 13 others, including livestock farms, waste deposits and gases.

The decree n°2015-1200 of September 29, 2015 and the corrigendum of October 10, 2015 bring the following modifications to the ICPE nomenclature (classified installations):

  • three sections have been deleted
  • thirteen sections have been modified

Here are the details of the changes to the ICPE nomenclature ...

The three headings removed from the nomenclature are :

  • 187 (glass tinning workshop),
  • 1521 (processing or use of tar, asphalt, pitch and bituminous materials),
  • 2320 (milling workshop)

The thirteen modified headings are :

  • Subheading 1414 (filling or distribution of liquefied flammable gases): for subheading 1414-4, tank-to-tank loading or unloading installations, it is specified that those operated solely for tank maintenance purposes are now excluded from the subheading.
  • Heading 1434 (filling or distribution of flammable liquids, combustibles, heavy fuel oils, crude oils): the scope of application has been modified to mention that this heading does not only concern flammable liquids; it also concerns combustible liquids with flash points between 60°C and 93°C, heavy fuel oils and crude oils.
  • Heading 1435 (service stations): it is specified that the fuels concerned are liquid fuels.
  • Heading 2111 (breeding, sale of poultry, feathered game): registration has been introduced for poultry and/or feathered game farms with more than 30,000 sites, with one animal = one site. Facilities classified under heading 3660 (heading applicable from 40,000 sites) remain subject to Authorization. The criterion of animal-equivalents is retained for facilities subject to declaration (D or DC) under sub-heading 2111-3. The introduction of the registration system will come into force on the date of publication of the general prescriptions decree.
  • Heading 2731 (deposit or transit of animal by-products): the scope has been extended. In addition to "depots", the heading now also covers the transit of animal by-products, and is subdivided into two subheadings. Activities involving the deposit or transit of animal by-products in sealed, covered containers, without handling the animal by-products, are subject to registration (if the tonnages likely to be present at the facility are greater than 500 kg and less than 30 tonnes of animal by-products). Other facilities covered by this heading are subject to authorization if the quantity likely to be present in the facility exceeds 500 kg. In addition, to take account of the latest regulatory developments, the following exclusions have been specified: depots covered by headings 2171 and 2355, bio-waste depots and depots attached to and directly linked to facilities whose activities are classified under headings 2350, 2740, 2780, 2781, 3532, 3630, 3641, 3642, 3643 and 3660 are thus excluded from classification under this heading.
  • Heading 2792 (facility for the transit, sorting and grouping of waste containing PCB/PCT at a concentration of over 50 ppm): a correction has been made to specify that the authorization requirement also applies to facilities for the transit, sorting and grouping of waste containing PCB/PCT where the quantity of fluid containing PCB/PCT is equal to 2 t.
  • Heading 2793 (facility for the collection, transit, grouping, sorting or other treatment of waste explosive products): for facilities for the collection of waste explosive products brought in by the original producer of such waste, the authorization system now applies as soon as the total equivalent quantity of active material is equal to 100 kg. The same applies to facilities for the transit, grouping or sorting of explosive waste.
  • Heading 4110 (acute toxicity category 1 by at least one route of exposure, excluding uranium and its compounds): a correction has been made to add a) and b) to subheading 4110-3.
  • Category 4310 (flammable gases, categories 1 and 2): the notion of underground cavities is clarified to include natural strata, aquifers, salt caverns and disused mines.
  • Heading 4718 (Category 1 and 2 liquefied flammable gases and natural gas): the heading now specifically includes natural gas. The notion of underground cavities has been clarified to include natural strata, aquifers, salt caverns and disused mines.
  • Heading 4733 (specific carcinogens): corrections have been made to the wording of the heading. The words "2-naphthylamine" are replaced by "2-naphthylamine" and "propanesulfone" by "propanesultone".
  • Subheading 4734 (specific petroleum products and alternative fuels): double-enclosed storage facilities with leak detection systems have been removed from subheading 4734-1. Underground cavities and buried storage facilities are now the only ones covered. Thresholds remain unchanged.
  • Heading 4802 (fluorinated greenhouse gases): the wording of the heading is rewritten to take account of the publication of the F-Gas Regulation (Regulation No. 517/2014), which repealed Regulation (EC) No. 842/2006, without any substantive change.

In addition to these changes to ICPE (classified facility) nomenclature headings, the approval procedure for organizations carrying out periodic inspections of certain facilities subject to declaration has been simplified. The approval order will no longer list the headings, but the perimeter for which the periodic inspection body is competent. This means that, in the event of a change in the headings, the organization will not have to take any administrative steps.

All the changes to the nomenclature came into effect in October 2015.
